WashTec offers users the possibility to leave individual comments on each blog contributions on any blog, that is on the website of the controller. 1.    Scope

This statement applies to you if you are a current or future Business partner of WashTec (e.g., a consultant or sole trader) or an employee of a Business partner who is in contact with WashTec on behalf of this Business partner.


2.    Categories of personal data

In the course of our cooperation with Business partners, we process personal data of end users and contact persons at customers, interested parties, sales partners, suppliers and partners (each a "Business partner"):

i. Contact information, such as first and last names, business address, business telephone number, business mobile phone number, and business email address

ii. Organizational information, including position and company name,

iii. Contract and payment data, such as information required for the execution of contracts, payment transactions, or fraud prevention, including credit card information and card verification numbers

iv. Further information that is necessary for processing within the scope of a project or the execution of a contractual relationship with us or that is provided voluntarily by business partners, e.g. in the context of orders placed, inquiries, or project details

v. Personal data collected from publicly available sources (including company or professional social networks and websites), information databases or credit agencies, and

vi. Information that is legally required in the context of compliance and export control screenings, such as date of birth, nationality, place of residence, ID numbers, information on relevant court proceedings and other legal disputes in which business partners are involved.

WashTec may disclose your business partner data to third parties for the following processing purposes:

  • Within the WashTec Group: WashTec and any company within the WashTec Group may receive your personal data for Processing purposes, in particular to carry out regular checks to ensure compliance with applicable laws and internal guidelines, and to respond to or comply with requests and legal requirements.

  • within certain acquiring or acquired companies: if WashTec's business is sold or transferred in whole or in part, or if WashTec acquires another entity and integrates it into WashTec's business (or if a similar transaction is sought), Your personal data may be transferred prior to the transaction (e.g., as part of due diligence) or after the transaction in accordance with the relevant legal provisions, including the legal system applicable to the other company.

  • To processors: certain third parties, whether or not they are affiliated companies, may receive your personal data in order to process such data in accordance with instructions ("processors") if this is necessary for the purposes of processing, in particular to provide IT and other administrative support (e.g., service providers who provide creditor support or IT hosting and maintenance support), to comply with applicable laws, and for other activities. Processors are contractually obligated to implement appropriate technical and organizational measures to secure personal data and to process personal data only as instructed.

Only those persons who need to know this information in order to perform their professional duties have access to your personal data. WashTec may disclose your personal data to government authorities, courts, external advisors, and similar third parties to the extent required or permitted by law.

International transfers 

The personal data we collect and receive from you may be transferred to and processed by recipients located within or outside the European Economic Area ("EEA"). Some of the recipients outside the EEA are certified under the EU-US Data Privacy Framework and others are located in countries with existing adequacy decisions. In any case, a level of data protection recognized as adequate from a European data protection perspective will be ensured during the transfer. Other recipients may be located in countries that do not ensure an adequate level of data protection from a European data protection perspective. We will take all necessary precautions to ensure that all data protection security measures are taken when transferring data to countries outside the EEA. With regard to transfers to countries that do not ensure an adequate level of data protection, we will take appropriate security measures during the transfer, such as concluding standard contractual clauses of the European Commission or introducing approved codes of conduct together with binding and enforceable obligations on the part of the recipient. You can contact us as specified in Section 8 below and request a copy of such appropriate security measures.

 

5.    Retention periods

Your personal data will be stored by WashTec and/or our service providers in accordance with applicable data protection laws, to the extent necessary to fulfill our obligations and only for the period necessary to fulfill the purposes for which the data was collected. If WashTec no longer needs your personal data, we will remove it from our systems and records and/or take steps to ensure that it is properly anonymized so that you can no longer be identified from it (unless we need to retain your data to comply with legal or regulatory obligations to which WashTec is subject).

Personal data in contracts, communications, and business letters may be subject to legal retention requirements that require retention for up to ten years. All other business partner data will generally be deleted five years after the end of the business relationship between you and WashTec.

 

6. Rights

Right to withdraw your consent: If you have given your consent to certain types of processing activities, you may withdraw this consent at any time with effect for the future. Such withdrawal will not affect the lawfulness of the processing carried out on the basis of your consent until withdrawal.

Right to object: Under certain circumstances, you have the right to object to the processing of your personal data by us at any time for reasons arising from your particular situation, and we are obliged to no longer process your personal data. If you have a right to object and if you exercise this right, your personal data will no longer be processed by us for these purposes. You can exercise this right by contacting us as specified in Section 8 below.

 

Under the EU General Data Protection Regulation, you also have the following rights: 

  • If your personal data is processed, you have the right to obtain information about the data stored about you (Art. 15 GDPR). 

  • If incorrect personal data is processed, you have the right to have it corrected (Art. 16 GDPR).

  • If the legal requirements are met, you can request the deletion or restriction of processing and object to processing if this arises from your particular situation (Articles 17, 18, and 21 of the GDPR).

  • If you have consented to data processing or if a contract for data processing exists and the data processing is carried out using automated procedures, you may have a right to data portability (Art. 20 GDPR).

  • You also have the right to lodge a complaint with a competent data protection supervisory authority in the relevant member state (e.g., in the member state of your habitual residence, place of work, or place of the alleged violation of the GDPR).

7. Contact form on our website

Description

The data you enter will be processed for individual communication with you and, if necessary, for the purpose of acquiring, surveying, and informing interested parties. For this purpose, we collect your full name (including title), contact details (such as address and email address), and the content of your request, depending on your request. This data and time stamps are used to assign your request and subsequently respond to it. The provision of further data is optional.

Legal

The data entered in the contact form is processed on the basis of our legitimate interest (Art. 6 para. 1 lit. f) GDPR) in processing your request. By providing the contact form, we would like to make it easy for you to contact us.

If you contact us to request a quote, the data entered in the contact form will be processed for the purpose of taking steps prior to entering into a contract (Art. 6 para. 1 lit. b) GDPR).

Recipients

The recipients of the data are any processors. A transfer to a third country is not planned.

Storage

Personal data relating to a pure enquiry will be stored for as long as is necessary to process the enquiry; as a rule, this data will be deleted at the latest 6 months after processing or completion of the enquiry. If a contractual relationship is established, we are subject to the statutory retention periods of the German Commercial Code (HGB) and will delete your data after these periods have expired.

Necessity

The provision of your personal data is voluntary. However, we can only process your request if you provide us with your name, contact details, and the reason for your request.

1.      Categories of personal data and purposes of processing: What personal data do we process and why?

1.1    Metadata

You can use the website without providing personal data about yourself. In such cases, we collect only the following metadata, which results from the use of the website: Browser type and version, operating system and interface, referring website (referral URL), pages viewed, the date and time you access our website, and your Internet Protocol (IP) address.

  • Within the WashTec Group: We and any company in the WashTec Group may receive your personal information for the purposes described above. Internal departments within WashTec may receive your personal data commensurate with the categories of personal data and purposes for which the personal data was collected. In addition, further departments within WashTec may have access to personal data about you on a need-to-know basis, for example the legal department, the finance department or the internal audit department.

Your personal data will be stored for as long as is necessary to provide you with the services and products you request. When your contractual relationship with us comes to an end or your account is deleted, or when you terminate your relationship with us in any other way, we will remove your personal data from our systems and records and/or properly anonymise it so that you can no longer be identified from it (unless we have to retain your data to comply with legal or regulatory obligations to which WashTec is subject, such as for tax reasons).

We may retain your contact details and information about the interest you have expressed in our products and services for a longer period if you have consented to WashTec sending you marketing materials. We may also be required under applicable law to retain certain personal data for a period of ten years after the relevant tax year. We may retain your personal data after termination of our contractual relationship if your personal data is necessary for compliance with other applicable laws or if we require your personal information, exclusively on a need-to-know basis, in order to establish, exercise or defend a claim in law. As far as is possible, we will restrict the processing of your personal data to such limited purposes after termination of our contractual relationship.
